Resignation or Removal of a Guardian or Conservator
You are responsible
If you are a guardian or conservator, your responsibilities last until the protected person dies or the court ends your appointment.
Utah Code Section 75-5-306, Section 75-5-307 and Section 75-5-415.
Resignation
If you are a guardian or conservator and can no longer handle your responsibilities, file a motion with the court asking to resign.
See our page on changing or ending a guardianship or conservatorship for help.
Motion to remove the guardian or conservator
The protected person or anyone interested in the protected person's welfare may file a motion with the court asking the court to remove the guardian or conservator. See our page on asking the court for help.
Final accounting report
If a guardian or conservator resigns or is removed, the conservator — or the guardian if there is no conservator — must file a Final Accounting Report with the court and provide copies to the interested persons. For more information and forms, see our page on Reports Required from the Guardian and Conservator.
Ending is different from resigning
Resigning or being removed as the guardian or conservator is different from ending the guardianship or conservatorship itself. If the court accepts your resignation or you are removed, the court will appoint a new ("successor") guardian or conservator. The guardianship or conservatorship itself will end only if the protected person dies or the court determines that the protected person is no longer incapacitated. See our page on changing or ending a guardianship or conservatorship for help.
