Asking to Change or End a Guardianship or Conservatorship

You can ask the court to change or end a guardianship or conservatorship if you are:

  • the protected person
  • a friend or relative of the protected person or
  • the guardian or conservator

The protected person is the person who has a guardian or conservator to help them.

How old is the protected person?

For minors, a guardianship ends automatically if certain events happen. See the section below called "End a guardianship or conservatorship."

To change the guardian's or conservator's powers, file a motion asking for review. The court can ask things like:

  • Is guardianship or conservatorship is still needed?
  • What powers should the guardian or conservator have?
  • Has the guardian or conservator made decisions good decisions for the minor?

Are you the protected person under a guardianship or conservatorship?
You can still:

  • stay as independent as you can based on your current abilities
  • have freedom in all parts of your life not controlled by the guardianship 
  • ask the court to review your guardianship if your abilities have improved
  • have someone speak up for you about your concerns.

Utah Code 75-5-301.5(1)(c) and (2)(h).

You can file a motion asking for review. The court can ask things like:

  • Is guardianship or conservatorship is still needed?
  • What powers should the guardian or conservator have?
  • Has the guardian or conservator made decisions good decisions for the protected person?

If your motion is about the protected person's ability to be independent (capacity), they can have a laywer at the hearing. The court will find a free lawyer if they cannot afford one. 

Utah Code 75-5-301.5 (2)(a) and 75-5-303 (2)(b).

How old is the protected person?

Just moving within the county?

Just tell everyone about the move. 

Send a letter or email to the clerk of the court that appointed you. Include your case number and the protected person's name. Be sure to send a copy to all interested persons. 

Moving to another county? 

Transferring a guardianship or conservatorship to another county within Utah is called a "change of venue." You need the court's permission.

Utah Code Section 75-5-403.

Follow the steps below to ask the court for help.

There is no process for transferring a guardianship or conservatorship of a minor into or out of Utah.

To move a guardianship or conservatorship into Utah:
End the guardianship in the other state and file a petition to appoint a guardian or conservator in Utah

To move a guradianship or conservatorship out of Utah:
File a motion to terminate the Utah guardianship or conservatorship (scroll down on this page) and file a petition to appoint a guardian in the other state.

How old is the protected person?

A guardianship of a minor ends automatically when:

  • the guardian: dies, quits and the court approves it, or is removed by the court
  • the minor: dies, is adopted, marries, turns 18, or is emancipated

When any of these happen, the guardianship is over. The guaridan just needs to file the final reports.

Are you the parent of a minor child under a guardianship?
If your guardianship is in district court and your custody rights have not been taken away, you can ask the court to formally end the guardianship. The court must grant your request. 

To ask the court to formally end the guardianship, follow the instructions below.

Utah Code 75-5-210 and In Re V.K.S., 2003 UT App 13.

A conservatorship of a minor ends when the protected person, their representative, or the conservator asks the court to end the conservatorship. Once the conservatorship has ended, the money and property pass to the former protected person.

A guardianship can end when:

  • the guardian dies or becomes unable to serve
  • the guardian resigns or is removed, with court approval, or
  • the protected person dies or regains their ability to be independent (capacity).

The guardian, the protected person, or anyone concerned about the protected person can ask the court to end the guardianship.

A conservatorship ends when the protected person, their representative, or the conservator ask the court to end the conservatorship. Once the conservatorship has ended, the money and property pass to the former protected person.
