Rule 1.General provisions.

(a) Scope of rules. These rulesshall govern the procedure in the courts of the state of Utah in all actions,suits, and proceedings of a civil nature, whether cognizable at law or in equity,and in all special statutory proceedings, except as governed by other rulespromulgated by this court or enacted by the Legislature and except as stated inRule 81. They shall be liberally construed to secure the just, speedy, andinexpensive determination of every action.

(b) Effective date. These rulesshall take effect on January 1, 1950; and thereafter all laws in conflicttherewith shall be of no further force or effect. They govern all proceedingsin actions brought after they take effect and also all further proceedings inactions then pending, except to the extent that in the opinion of the courttheir application in a particular action pending when the rules take effectwould not be feasible or would work injustice, in which event the formerprocedure applies.
