Cap on Damages
Utah Code Section 78B-3-410 establishes a cap on non-economic losses in malpractice actions against health care providers. The statute requires the state treasurer to certify to the Administrative Office of the Courts annual adjustments based on inflation. The statutory base adjusted for inflation as certified by the state treasurer is reported here. Non-economic losses in causes of action arising on or after the dates specified are limited to the amount specified but rounded to the nearest $10,000. See Section 78B-3-410 for details.
